An Enduring POA allows you to appoint one or more trusted persons to assist you in relation to financial and legal decisions or act on your behalf when you need help. Please note that you can limit the powers that your attorney has and decide when the Enduring POA takes effect, for example when your treating doctor says that you no longer have the capacity to act on your own or at any other time you might specify.

An Enduring Guardian allows you to appoint one or more trusted persons to assist you in relation to health and make lifestyle decisions or act on your behalf when you need help. Please note that you can limit the powers that your attorney has and decide when the Enduring POA takes effect, for example when your treating doctor says that you no longer have the capacity to act on your own or at any other time you might specify.

The word ‘Enduring’ means that the power will continue to be effective even after you lose capacity to manage your own personal affairs.

If you lose capacity before making the above appointments, your family members or friends would be required to apply to the NSW Guardian Tribunal to be appointed as your Guardian before they would be able to make any of these decisions on your behalf.
